Worker and Applicant Privacy Policy
RXO, Inc. and its subsidiaries, affiliates and entities we provide services to (collectively, “RXO”) respect the relevant legal privacy rights of its workers and job applicants
In collecting, using, or disclosing Personal Information about current or potential employees, RXO will adhere to the obligations set out in this policy and applicable local laws. Where there is a conflict between local law and this policy, local law will apply.
RXO generally collects information which relates to an identified or identifiable individual (“Personal Information”) on the legal basis of our legitimate interest in acquiring and managing quality talent. Should we need your consent to collect certain types of data (for example your race or ethnicity) we will obtain your consent before collecting this type of Personal Information.
Collection
Information voluntarily provided by Applicants
To apply for employment or to receive information from the RXO about job openings, you may be asked to provide Personal Information. The Personal Information that you may be requested to provide may include:
- Name
- Contact information, including home address, home telephone, mobile telephone and email address
- Date of birth
- Tax Identification or other government identification number
- Work history
- Education history and results
- Citizenship
- Eligibility or right to work
- Interest in employment opportunities
- Job specific questions that relate to your fitness for a particular position
- Employment history
- Information regarding potential conflict of interest issues
- Information you provide to create security questions and answers used to validate your identity when you return to the Site
Information provided by Workers
As part of your working relationship with RXO, you will be asked to provide Personal Information in addition to the information you may have provided as an applicant. The Personal Information that you may be requested to provide may include:
- Beneficiary information
- Information necessary for RXO to manage your working relationship with us (e.g. scheduling information, ability to work information, workplace safety information, etc.).
In some countries, RXO may ask individuals to self-identify certain Personal Information such as their ethnicity, gender, veteran status, and disability information. That information is voluntary and your decision to provide or withhold any of that information will not negatively impact whether or how RXO will consider you for employment.
RXO will treat any Personal Information considered sensitive under applicable law in accordance with that applicable law. The collection and use of sensitive Personal Information will be limited to that which is strictly necessary for the purposes for which it was collected. Your explicit consent will be obtained to the processing of your sensitive Personal Information, unless otherwise permitted by applicable law.
Use of Personal Information
Any Personal Information collected will be used to:
- enable you to express interest in and/or allow you to apply for employment within RXO;
- consider your candidacy for employment within RXO;
- comply with any applicable legal and regulatory requirements involving job applicants, which may include providing reports to government agencies;
- verify your identity to ensure security for one of the other purposes listed in this policy;
- populate your employee records in the event you are hired by RXO;
- manage you as part of RXO’s workforce if you are hired;
- ensure or enhance the security and functionality of RXO’s electronic systems;
- protect against fraud; and
- conduct internal investigations and comply with legal obligations.
- Personal information is used only in ways that are compatible with the purposes described in this policy.
RXO takes commercially reasonable steps to ensure that the Personal Information is relevant to its intended use and is accurate, up-to-date, and complete.
IT Use Information
RXO monitors its user traffic patterns throughout RXO’s IT network and systems. This includes a user’s domain name, browser type, date and time of access, software usage, application access times, and internet viewing history. This information is collected in order for RXO manage its IT resources, protect its workers and visitors, enhance its users’ experience on websites and RXO’s intranet, and to generally run its business.
RXO uses a number of automated technologies to collect this kind of IT use data. For example, cookies and web beacons are used internally and externally to collect aggregate and anonymous usage data, as well as worker-specific activity inside the RXO network. RXO may also use Personal Information to personalize its user’s interaction with RXO. For example, the RXO applicant website may permit you to select a language and/or geographic location preference, which will be stored for future visits.
RXO’s service providers also use automated tracking technology to manage IT activity while users are in the network. These technologies track sessions, user inputs, and user authentication.

RXO does not share worker or applicant Personal Information for the purposes of cross-contextual behavioral advertising.
Sharing of Personal Information
Within RXO
Because RXO operates globally with locations in many different countries, we may transfer your information from one legal entity to another or from one country to another in order to accomplish purposes listed in this policy. We will transfer your Personal Information in a manner that is consistent with applicable legal requirements.
With Third Parties
- RXO may share your Personal Information outside RXO to:
- service providers RXO has retained to perform services on its behalf;
- entities that have retained RXO to perform services on their behalf;
- comply with legal obligations, including in response to a legitimate legal request from law enforcement authorities or other government regulators;
- maintain the security and integrity of our networks and systems;
- investigate suspected or actual illegal activity;
- prevent physical harm or financial loss; or
- support the sale or transfer of all or a portion of our business or assets (including through bankruptcy).
- All service providers to RXO will use Personal Information only for the purposes identified in this policy and will provide services under a contract which restricts use of information to that which is necessary to perform services on our behalf or to comply with legal requirements.
International Transfers
Given that RXO entities are located and provide services all over the world, we need to transfer your Personal Information internationally. In particular, Personal Information collected by us in the European Economic Area (“EEA”) and UK may be transferred to and processed in countries outside the EEA or UK. Those countries may not have the same level of protection for Personal Information as in the EEA or UK.
Where we transfer your data outside of the EEA we have in place approved mechanisms (for example, the Standard Contractual Clauses adopted by the European Commission for the transfer of personal data, or your consent) legitimizing such transfers.
State Privacy Rights
Pursuant to certain state laws (for example, California Civil Code Section 1798.100 et. seq) these states may provide their residents a number of rights as they relate to Personal Information. These are the “right to know,” the “right to correct”, the “right to delete,” and the “right to opt-out.”
Right to Know. You may request that RXO provide you the specific pieces of Personal Information RXO has about you; categories of Personal Information we have collected about you; categories of sources from which the Personal Information is collected; categories of Personal Information that RXO sold or disclosed for a business purpose about you; categories of third parties to whom the Personal Information was sold or disclosed for a business purpose; and the business or commercial purpose for collecting or selling Personal Information. Please note that much of the information you can make a request for is already contained in this Privacy Policy. Should you wish to exercise this right, please see the section below which explains how to do so. If you do not have an account with RXO, we may ask for some Personal Information in order to verify your identity and your rights to the data subject to your request.
Right to Correct. Some state law gives their residents a limited right to request correction of Personal Information which is incorrect. However, this right is limited in that data which is objectively correct, or is opinion data is not subject to a correction request. Fundamentally, much of the Personal Information RXO processes is automatically and objectively processes. As such, requests to correct Personal Information are usually limited to Personal Information which you have provided directly to us. If you would like to request correction of Personal Information, you may use any of the self-management tools on our website. If you cannot correct your Personal Information using those on-line tools, please see the section below which explains how exercise your privacy rights. If you do not have an account with RXO, we may ask for some Personal Information in order to verify your identity and your rights to the data subject to your request.
Right to Delete. Some state law gives their residents a limited right to request deletion of their Personal Information. However, this right is limited by a number of exceptions. Fundamentally, if RXO has a permissible need to retain Personal Information, we are not under an obligation to delete such information, even when requested. Generally, we retain Personal Information so we may complete the transaction for which the Personal Information was collected or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between us and you; detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity; debug to identify and repair errors that impair existing intended functionality of our online properties; enable solely internal uses that are reasonably aligned with your expectations based on your relationship with RXO; comply with a legal obligation; or otherwise use your Personal Information, internally, in a lawful manner that is compatible with the context in which your provided the information. As such, we generally do not accept requests to delete Personal Information. However, we will respond to requests to remove Personal Information from some of our systems as a part of a request to close or otherwise disable a worker account. If you would like to request deletion of Personal Information, please see the section below which explains how to do so. If you do not have an account with RXO, we may ask for some Personal Information in order to verify your identity and your rights to the data subject to your request.
Right to Opt-Out. RXO does not sell, or share for purposes of cross-contextual behavioral advertising, your Personal Information to third parties for their own marketing purposes.
Designating an Authorized Agent. California law permits California residents to designate an agent to manage their rights under California law. If you would like to designate an agent to manage your privacy preferences, you may do so using the mechanisms noted below under “Exercising Privacy Rights”. Note that if you do not have an account with RXO, we may ask for some Personal Information in order to verify your identity and your rights to the data subject to your request. We will also need sufficient Personal Information about your authorized agent to be able to identify them. As part of this process, you must have permission from your authorized agent to disclose their Personal Information to us for the purpose of acting as your agent.
Non-discrimination. RXO will not discriminate against you because you exercised any your rights in this Policy.
Exercising Privacy Rights. If you are a resident of a state with specific privacy laws and would like to exercise any of your rights you may do so by accessing your account or registration page on the website or intranet page you regularly interact with RXO. Please provide us with sufficient information that enables us to verify your identity and the rights you have in the data subject to your request.
Third-Party Links
In some instances, RXO may provide links to non-RXO controlled Sites. These can include links to social media sites (via “widgets”) like Facebook or LinkedIn. However, RXO does not control such third-party Sites, and cannot be responsible for the content or the privacy practices employed by other Sites.
Safeguards
RXO has in place physical, electronic and procedural safeguards appropriate to the sensitivity of the information we maintain. Safeguards will vary depending on the sensitivity, format, location, amount, distribution and storage of the Personal Information. They include physical, technical, and managerial measures to keep Personal Information protected from unauthorized access. However, due to the nature of the internet and related technology, we cannot absolutely guarantee the security of Personal Information, and RXO expressly disclaims any such obligation.
Data Retention
RXO retains Personal Information as is reasonably necessary to fulfill the purposes described in this Policy. Your Personal Information will be retained as part of RXO’s records retention policy.
Regarding the recruiting process, RXO keeps the Personal Information that we obtain about applicants for no longer than is necessary for the purpose for which it is processed, being specified that for unsuccessful applicants, this information will be erased at the latest two (2) years following the last contact or in accordance with local laws.
Changes to this Policy
As RXO expands and improves this Site, we may need to update this policy. This policy may be modified from time to time without prior notice. We encourage you to review this policy on a regular basis for any changes.
